This Cancellation and Refund Policy (“Cancellation and Refund Policy” or “Agreement”) is made and entered into by and between Fused Portal Services (“splidu”, “we”, “us”, or “our”), a corporation organised and existing under the laws of the United Arab Emirates (“UAE”), with its head office located at 39th Floor, Czar Business Center, The One Tower, Barsha Heights, Dubai, United Arab Emirates, and any person who accesses and uses the Platform, and by clicking a button or checking a box marked ‘I Agree’ has agreed to all the Terms and Conditions.

 

You are required to read and accept this Agreement before you may use the Platform and/or the Platform Services. By visiting, accessing and/or using the Platform, we understand that you have fully read, understood, and accepted this Agreement. In addition, when you use any current or future version of the Platform or avail any of the Platform Services or click the "I Agree" button on the Platform, it will constitute a symbol of your signature.

 

You hereby acknowledge and admit that you have read, understood, and accepted to be bound by this Cancellation and Refund Policy, as may be modified by splidu from time to time. Any amendments or variations thereto shall take effect from their date of publication on the Platform.

 

Terms not defined in this Agreement shall have the same meaning as that defined in the Terms and Conditions published on the Platform.

 

1 CANCELLATION OF PLATFORM SERVICES

 

1.1 All cancellations must be made via the Platform.

 

1.2 The confirmation for any booking made via the Platform is subject to splidu’s approval. splidu may, in its sole discretion, not provide the Platform Services to a User, or cancel a Confirmed Booking for any reason.

 

1.3 The Vendor may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to the Platform Service being provided by the Vendor. The Customer shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Vendor from whom the Customer is availing the Platform Service.

 

1.4 In the event that any of the terms, conditions and notices contained in this Cancellation and Refund Policy conflict with the additional /other terms and guidelines specified by the Vendor, then the latter terms/guidelines shall prevail.

 

1.5 In the event any Vendor cancels the Confirmed Booking of any Platform Service, the Customer will be entitled to a full refund of the amount paid for the cancelled Platform Service

2 UNDERGROUND DINING/ PRIVATE CHEF

 

2.1 The Vendor will define the cancellation policy for each experience on the Platform. In completing a booking for an experience, the Customer/User accepts the cancellation terms and defined refund terms on the Platform.

 

2.2 All refunds will be reimbursed into the Users unique wallet on the Platform or provided a unique discount code to the value of the refund if they are a guest user.

 

2.3 If the Customer/User chooses to get a refund back into their credit card, they can contact splidu who will execute the transaction subject to any associated costs, (currently 11% which includes payment gateway charges both ways and an admin charge), including, but not limited to any bank transfer fees or credit card fees for the said transaction.

 

2.4 If Customer/User fails to cancel a Confirmed Booking or fails to notify us of Customer ‘s inability to attend Underground Dining (i.e., for a no-show), Customer will not be entitled to any refund and shall be liable to pay the Booking Amount in full.

 

3 REFUND TERMS

 

3.1 Refunds, if any, on cancelled bookings will always be processed to the original payment mode (credit card, debit card etc.) from which payment was made for the cancelled booking, subject to the following procedure:

 

  1. all refunds will first appear in the In-App Token of the Customer; and

 

  1. upon the request of the Customer, such refund will be processed to their original payment mode, as defined in the Terms & Conditions under In-App Token.

 

3.2    Timeline, for all refund amounts, will be driven by the respective bank and payment gateway provider timelines after splidu has processed the refund, processed once on a bi-weekly basis.

 

3.3 The decision on refunds shall be at the sole discretion of splidu and shall be final and binding.
